In the State of Florida, a person’s driver’s license can be suspended for numerous different reasons. Suspensions can occur for unpaid fines, failure to appear in Court, the lack of payment of child support, for insurance reasons, for specific offenses including DUI, Vehicular Homicide and Drug offenses, the accumulation of too many points from traffic infractions, and for a person being designated as an Habitual Traffic Offender. For many years, a person who has been arrested for driving in violation of the Habitual Traffic Offender law has been treated quite seriously in County Court. However, in recent statutory changes, drivers charged with Habitual Offender revocations can now be arrested and charged with a third degree felony. Therefore, a person charged with violating this statute now faces a serious felony offense punishable by up to five years in State prison or a fine of $5,000.00. The Florida Legislature has also made these offenses worse by adding specific statutory aggravated factors and circumstances. For example, driving in violation of an Habitual Traffic Suspension and causing an accident which results in death or serious bodily injury is now even more serious of an offense. Likewise, a person caught driving recklessly combined with a suspension charge will have his punishment increased in severity. All State Attorneys throughout the State of Florida take these offenses quite seriously and aggressively prosecute all of them.
